Terms of Service

These Terms of Service ("Terms") govern your access to and use of Diavisor, a diabetes data and insulin-dose calculation tool operated by Magma Company GmbH, Salvemattweg 11, 6340 Baar (ZG), Switzerland ("Magma Company", "we", "us", "our").

Diavisor is made available by invitation only, free of charge, and as experimental software. By accepting an invitation, creating an account, or using Diavisor in any way, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use Diavisor.

Safety notice — read this before anything else

Diavisor can get it wrong. Insulin errors can cause severe hypoglycaemia, brain injury, coma, or death.

• Never inject a dose because Diavisor suggested it. Every dose is your decision, and you are responsible for checking it before you act.
• Diavisor is not a substitute for your own judgement, your blood glucose meter, or your diabetes care team.
• Confirm every reading with a fingerstick blood glucose test before dosing, treating a low, or acting on anything the app shows.
• Do not rely on Diavisor's alerts to keep you safe. They can be delayed, wrong, or silently absent. See Section 8.
• If you feel unwell, or your readings and your symptoms disagree, trust your symptoms and your meter, not the app.
• In an emergency, contact your local emergency services. Diavisor is not monitored and cannot summon help.

If you are not willing and able to independently verify everything Diavisor produces, you must not use it.

1. Definitions

• "Diavisor" or the "Service" — the Diavisor mobile applications, web application, application programming interfaces, and any related software, documentation, and websites operated by Magma Company.
• "You" or "User" — the individual who has been invited to and uses the Service. Diavisor is offered to natural persons for personal use only.
• "Health Data" — blood glucose readings, insulin doses, carbohydrate and meal entries, insulin settings (such as insulin-to-carbohydrate ratios, correction factors, target ranges, and insulin duration), photographs of meals, notes, and any other health-related information you enter or connect.
• "Connected Service" — a third-party service you choose to link to Diavisor, including continuous glucose monitoring ("CGM") providers, Nightscout instances, insulin pens read over NFC, and messaging services.
• "Invitation" — the access key, invitation, or other credential issued by us that permits account creation.

2. What Diavisor is, and what it is not

2.1. Diavisor is a personal record-keeping and arithmetic tool. It stores diabetes-related information you provide or connect, performs calculations on it, and displays the results back to you.

2.2. Diavisor is not:

• a medical device that has been placed on the market, CE-marked, cleared, approved, registered, or certified by any regulatory authority, including Swissmedic, the European Commission or any EU notified body, the U.S. Food and Drug Administration, or any other competent authority;
• a diagnostic tool;
• a treatment, therapy, prescription, or dosing authority;
• a clinical decision support system intended for use by healthcare professionals;
• a monitoring, alarm, or life-safety system;
• a substitute for professional medical advice, diagnosis, or treatment;
• a substitute for a blood glucose meter, CGM, insulin pump, or any other regulated device.

2.3. Diavisor is supplied for personal, non-commercial, experimental evaluation by a limited number of invited individuals. It is not offered to the general public, not advertised, not sold, and generates no revenue.

2.4. Nothing in the Service constitutes medical advice. Always seek the advice of your physician, diabetes specialist, diabetes nurse, or other qualified health provider with any question about your condition, your insulin settings, or any dose. Never disregard professional medical advice or delay seeking it because of something you read or calculated in Diavisor.

3. Experimental software

3.1. Diavisor is pre-release, experimental, and under active development. It has not completed clinical validation, formal verification, usability testing to any recognised standard, or independent audit.

3.2. You should expect, and accept, that Diavisor may at any time and without notice:

• produce results that are wrong, implausible, or internally inconsistent;
• display stale, incomplete, duplicated, or missing data;
• fail to deliver, delay, or wrongly deliver alerts and notifications;
• lose, corrupt, or fail to synchronise data you entered;
• become unavailable, in whole or in part, with or without notice;
• change in behaviour, including changes to how doses are calculated;
• be discontinued permanently.

3.3. Because Diavisor is experimental, the risk of using it rests with you. You accept that risk knowingly and voluntarily by using the Service. See Sections 18 to 20.

4. Invitation-only access and eligibility

4.1. Access requires a valid Invitation issued by us. We may decline, limit, suspend, or revoke an Invitation at any time, for any reason or no reason, without notice and without liability.

4.2. You may only create an account if all of the following are true. By creating an account, you represent and warrant each of them, on a continuing basis:

• you are at least 18 years old and have full legal capacity to enter into these Terms;
• you have, or are the parent or legal guardian of a person who has, diabetes and an established insulin regimen prescribed by a qualified clinician;
• you already know how to calculate and adjust your own insulin doses without software, and you can identify an implausible result;
• you have an independent, working blood glucose meter available at all times while using Diavisor;
• you are under the ongoing care of a qualified healthcare professional;
• you understand that Diavisor is experimental and unapproved, and you accept the associated risks;
• you are using Diavisor for yourself or for a dependant in your care, and not on behalf of any organisation.

4.3. Diavisor is not intended for and must not be used by: children or minors on their own account; persons unable to recognise or treat hypoglycaemia; persons without access to a blood glucose meter; healthcare professionals for the care of patients; hospitals, clinics, care homes, or other institutions; or anyone in an emergency or acute-care setting.

4.4. Your Invitation is personal. You may not share, transfer, sell, or sub-license access, and you may not permit anyone else to use your account.

5. Accounts and security

5.1. You are responsible for the accuracy of the information you provide, for keeping your credentials confidential, and for all activity under your account.

5.2. You must keep your device secured with a passcode or biometric lock. Anyone with access to your unlocked device may be able to see your Health Data and use the Service as you.

5.3. Tell us promptly at support@diavisor.com if you suspect unauthorised access to your account.

5.4. You may delete your account at any time from within the app. Deletion is described in Section 16 and in our Privacy Policy.

6. Your responsibilities when using Diavisor

You agree that you will, every time and without exception:

6.1. Verify every calculated dose independently before acting on it, using your own knowledge of your regimen and, where appropriate, your clinician's guidance.

6.2. Confirm blood glucose with a fingerstick meter test before dosing, before treating a suspected low, and whenever a reading looks wrong or disagrees with how you feel.

6.3. Check that your insulin settings in Diavisor are correct and current — insulin-to-carbohydrate ratio, correction factor, target range, insulin duration, maximum dose, and minimum glucose. Wrong settings produce wrong doses, and only you can confirm they match what your clinician prescribed.

6.4. Enter accurate data. Carbohydrate counts, glucose values, and dose records that you enter incorrectly will produce incorrect results.

6.5. Record every dose you actually take. Diavisor's insulin-on-board figure is only as good as the dose history it holds. A dose you took but did not record will cause Diavisor to underestimate active insulin and to suggest too much.

6.6. Not use Diavisor as your only record. Keep an independent record of doses and readings.

6.7. Discuss any change to your insulin settings with your clinician before making it. Any suggestion Diavisor makes about your settings is a statistical observation, not a prescription.

6.8. Stop using Diavisor and contact your clinician if you observe results you cannot explain.

7. Dose calculations

7.1. Diavisor's calculations are arithmetic applied to the settings and data you supply. They embody general assumptions about insulin behaviour that may not apply to you. Individual insulin sensitivity varies by person, time of day, illness, stress, exercise, hormones, injection site, insulin age and storage, and many other factors that Diavisor does not model.

7.2. Diavisor does not account for, among other things: exercise; alcohol; illness or infection; menstrual cycle; pregnancy; gastroparesis or variable digestion; fat and protein content of meals; other medicines; injection-site absorption differences; insulin that has expired or been stored incorrectly; or pump or pen malfunction.

7.3. Calculations may be performed on your device when it is offline, using the most recently cached settings. Cached settings may be out of date. Results computed offline may differ from results computed by our servers.

7.4. Any safety limit in the Service — including maximum-dose and minimum-glucose guards — is a convenience, not a safety system. It may be misconfigured, bypassed, or absent, and it does not make a suggested dose safe.

7.5. Where you override a suggested dose, the resulting dose is entirely your own decision and responsibility.

8. Alerts and notifications are not a monitoring system

8.1. Diavisor may display or send alerts about glucose values or trends. These are informational only and must never be relied upon.

8.2. Alerts will sometimes fail. Causes outside our control include: your device being off, asleep, in low-power mode, out of battery, or without network; notification permissions being off or restricted; operating-system limits on background activity; "Do Not Disturb" and Focus modes; carrier or push-service delays or outages; delays or outages at your CGM provider; and our own outages.

8.3. Diavisor is not an alarm system, not a medical monitoring service, and is not monitored by any person. No one at Magma Company sees your data in real time or will respond to an alert on your behalf.

8.4. Never rely on Diavisor to wake you, to warn you, or to detect a dangerous glucose level. Use a regulated CGM with its own alarms, and follow your clinician's guidance for overnight and unattended monitoring.

8.5. The absence of an alert means nothing. It does not indicate that your glucose is safe.

9. Connected Services and third-party data

9.1. You may link Connected Services, such as a CGM provider account, a Nightscout instance, an NFC-capable insulin pen, or a messaging service for alerts. Linking is entirely at your choice.

9.2. We do not control Connected Services. We do not warrant the accuracy, completeness, timeliness, or availability of any data obtained from them. Data may be delayed, wrong, incomplete, or absent.

9.3. Glucose data from a CGM is not equivalent to a blood glucose meter reading. It may lag actual blood glucose, particularly when values are changing quickly, and it may be inaccurate during sensor warm-up, at end of sensor life, or when the sensor is compressed or failing.

9.4. Where you supply credentials for a Connected Service, you confirm you are entitled to do so and that doing so does not breach your agreement with that provider. Your use of a Connected Service is governed by that provider's own terms and privacy policy.

9.5. We may add, change, or remove Connected Service integrations at any time. A provider may change or withdraw access without notice, breaking an integration.

10. Photo-based carbohydrate estimation

10.1. Diavisor may offer an optional feature that estimates the carbohydrate content of a meal from a photograph, using a third-party artificial-intelligence provider. Where you use it, your photograph is transmitted to that provider outside Switzerland. See our Privacy Policy and Sub-processors.

10.2. These estimates are frequently and substantially wrong. They are generated by a statistical model that cannot know portion size, recipe, hidden ingredients, or preparation method. They are a rough starting point only.

10.3. Never dose from an AI carbohydrate estimate without checking it yourself. Treat it as a suggestion to be corrected, not a measurement.

10.4. Do not photograph other people, documents, or anything you do not wish to send to a third party.

11. Sharing data with a clinician

11.1. Diavisor may let you generate a code granting temporary read access to your data so that you can share it with a clinician.

11.2. Generating and passing on such a code is your decision and your responsibility. Anyone holding a valid code can read the data it covers. Share codes only over a channel you trust, and only with a person you intend to have access.

11.3. A clinician viewing your data through Diavisor does so as your chosen recipient. We do not verify anyone's identity or professional qualification, and we take no responsibility for what any recipient does with your data.

12. Acceptable use

You must not, and must not allow anyone else to:

• use Diavisor for the diagnosis, treatment, monitoring, or care of any person other than yourself or a dependant in your care;
• use Diavisor in any clinical, institutional, research, or commercial setting;
• use Diavisor where failure could contribute to death, personal injury, or environmental or physical damage beyond your own care — including any use in emergency services, intensive or acute care, or automated insulin delivery;
• connect Diavisor to, or use its output to drive, any automated or closed-loop insulin delivery system;
• present, distribute, or resell Diavisor or its output as a validated, approved, or medically endorsed product;
• share, sell, sub-license, or transfer your account or Invitation;
• circumvent access controls, invitation gating, rate limits, or usage limits;
• reverse-engineer, decompile, or disassemble the Service, except to the extent that applicable law expressly permits it despite this restriction;
• copy, scrape, or systematically extract data from the Service, or access it by automated means other than the interfaces we provide;
• probe, scan, or test the security of the Service without our prior written permission, or attempt to access any account or data that is not yours;
• upload malware, or anything unlawful, infringing, or that you do not have the right to upload;
• interfere with, overload, or disrupt the Service or its infrastructure;
• use the Service in breach of any applicable law, including export control and sanctions law, or from a jurisdiction subject to comprehensive sanctions.

13. No fee, and no commitment

13.1. Diavisor is currently provided free of charge. No payment is due and none is accepted.

13.2. Providing the Service without charge does not create any obligation to continue providing it, to any standard, for any period.

13.3. We may introduce charges in future. If we do, we will tell you in advance, and you may stop using the Service and delete your account rather than pay.

14. Availability, changes, and discontinuation

14.1. We provide no service level, uptime commitment, or support commitment. There is no guaranteed response to any request.

14.2. We may at any time, without notice and without liability: change, add, or remove any feature; change how calculations work; impose or change limits; suspend the Service for maintenance; or discontinue Diavisor entirely.

14.3. We may require you to update to a newer version, and may block older versions from working — including where an older version contains a defect that makes it unsafe.

14.4. Keep your own copy of anything you need. We do not guarantee that your data will be retained, exportable, or recoverable, and we are not a backup service.

15. Your data

15.1. As between you and us, your Health Data is yours. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, process, transmit, and display it strictly as needed to operate the Service for you, to keep it secure, and to comply with law.

15.2. We do not sell your personal data, and we do not use your Health Data for advertising.

15.3. We may generate and use aggregated or anonymised statistics that cannot reasonably be used to identify you, including to improve the Service.

15.4. How we handle personal data, including the legal bases and your rights, is described in our Privacy Policy, which forms part of these Terms.

15.5. You represent that you have the right to provide any data you enter or connect, including where it relates to a dependant in your care.

16. Suspension, termination, and deletion

16.1. You may stop using Diavisor at any time, and may delete your account from within the app.

16.2. We may suspend or terminate your access at any time, with or without notice or reason, including where we believe you have breached these Terms, where we believe continued access presents a risk to you or others, or where we discontinue the Service.

16.3. On termination for any reason you may permanently lose access to all data held in the Service. Export anything you need beforehand.

16.4. We may retain data after termination where we are legally required to, or where necessary to establish, exercise, or defend legal claims, as set out in the Privacy Policy.

16.5. Sections 2, 3, 6 to 12, and 15 to 22, and any provision that by its nature should survive, survive termination.

17. Intellectual property and feedback

17.1. The Service, and all software, design, text, and other material in it, is owned by Magma Company or its licensors and is protected by intellectual property law. Except for the limited right to use the Service under these Terms, no rights are granted to you.

17.2. "Diavisor" and "Magma Company", and our logos, are our marks. You may not use them without our prior written permission.

17.3. If you send us feedback, bug reports, or suggestions, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use them for any purpose without obligation or attribution to you. Do not send us anything you consider confidential.

18. Disclaimer of warranties

18.1. The Service is provided "as is" and "as available", with all faults and defects, and without warranty of any kind.

18.2. To the fullest extent permitted by law, we disclaim all warranties, representations, and conditions, whether express, implied, statutory, or otherwise, including any implied warranty of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, non-infringement, and any warranty arising from course of dealing or usage of trade.

18.3. Without limiting the above, we do not warrant that: the Service will be uninterrupted, timely, secure, or error-free; any calculation, estimate, prediction, alert, or other output will be accurate, complete, appropriate, or safe for you; defects will be corrected; data will be preserved, synchronised, or recoverable; or the Service is fit for any medical, clinical, or safety-related purpose.

18.4. No advice or information, whether oral or written, obtained from us or through the Service, creates any warranty not expressly stated in these Terms.

18.5. Some jurisdictions do not allow the exclusion of certain warranties. Where that is so, the exclusions above apply to the maximum extent permitted, and your mandatory statutory rights are unaffected.

19. Assumption of risk

19.1. You acknowledge that using experimental, unapproved software in connection with insulin dosing carries a risk of serious harm, including severe hypoglycaemia, hyperglycaemia, diabetic ketoacidosis, seizure, loss of consciousness, permanent injury, and death.

19.2. You use Diavisor voluntarily, at your sole risk, and with full knowledge of that risk, having satisfied yourself that you are able to identify and correct any error it makes before acting on it.

19.3. You confirm that you are not relying on Diavisor as a safety measure, a monitoring system, or a source of medical advice.

20. Limitation of liability

20.1. To the fullest extent permitted by applicable law, Magma Company, and its directors, officers, employees, contractors, agents, and suppliers, shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or opportunity, arising out of or in connection with the Service or these Terms, whether in contract, tort (including negligence), strict liability, or otherwise, and whether or not we were advised of the possibility of such damages.

20.2. To the fullest extent permitted by applicable law, and subject to Section 20.3, our total aggregate liability arising out of or in connection with the Service or these Terms shall not exceed one hundred Swiss francs (CHF 100). You acknowledge that the Service is provided free of charge and that this limit reflects a reasonable allocation of risk on that basis.

20.3. Nothing in these Terms excludes or limits our liability where it may not lawfully be excluded or limited. In particular, and without limitation, nothing here excludes or limits liability:

• for death or personal injury caused by our negligence, where such exclusion is not permitted;
• for our own unlawful intent or gross negligence — any advance exclusion of which is void under Article 100(1) of the Swiss Code of Obligations;
• for fraud or fraudulent misrepresentation;
• under the Swiss Federal Act on Product Liability (PrHG) or equivalent mandatory product liability law; or
• under any other liability that applicable mandatory law does not permit to be excluded or limited.

20.4. If you are a consumer, your mandatory statutory rights under the law of your country of residence are not affected by these Terms.

20.5. The limitations in this Section apply even if a limited remedy fails of its essential purpose, and reflect the free, invitation-only, experimental nature of the Service, without which we would not make it available at all.

21. Indemnity

To the fullest extent permitted by law, you agree to indemnify and hold harmless Magma Company and its directors, officers, employees, contractors, and agents from and against any claim, demand, proceeding, loss, liability, damage, cost, and expense (including reasonable legal fees) arising out of or in connection with: your use of the Service; your breach of these Terms; your breach of any law or of any third party's rights; any decision you make about insulin, treatment, or care in connection with the Service; or your use of the Service for or on behalf of any other person. This does not apply to the extent the claim arises from our own unlawful intent or gross negligence, or where such an indemnity is not permitted by mandatory law applicable to you as a consumer.

22. Changes to these Terms

22.1. We may amend these Terms at any time. The current version is always published at legal.diavisor.com/terms, with the date of the most recent revision at the top.

22.2. Where a change is material, we will make reasonable efforts to notify you in advance, by email or in the app.

22.3. Continued use of the Service after a change takes effect constitutes acceptance. If you do not accept a change, you must stop using the Service and delete your account.

23. Governing law and jurisdiction

23.1. These Terms, and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims), are governed by the substantive law of Switzerland, excluding its conflict-of-law rules and excluding the United Nations Convention on Contracts for the International Sale of Goods.

23.2. The exclusive place of jurisdiction is Zug, Switzerland.

23.3. If you are a consumer, Sections 23.1 and 23.2 do not deprive you of the protection of mandatory provisions of the law of your country of habitual residence, and do not affect any right you have to bring proceedings in, or to be sued only in, the courts of that country where mandatory law so provides.

24. General provisions

24.1. Entire agreement. These Terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between you and us regarding the Service, and supersede all prior understandings.

24.2. Severability. If any provision is held invalid or unenforceable, it shall be modified to the minimum extent necessary to make it enforceable, or if that is not possible, severed. The remaining provisions continue in full force.

24.3. No waiver. A failure or delay in enforcing any provision is not a waiver of it.

24.4. Assignment. You may not assign or transfer these Terms or your account. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.

24.5. No third-party rights. These Terms do not confer rights on anyone other than you and us.

24.6. Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control.

24.7. Language. These Terms are drawn up in English. Any translation is for convenience only, and the English version prevails.

24.8. Relationship. Nothing in these Terms creates a partnership, joint venture, agency, employment, or clinician–patient relationship between you and us.
